WiLAN and UTStarcom Settle Litigation
OTTAWA, Canada – August 11, 2010 – Wi-LAN Inc. (“WiLAN” or the “Company”) (TSX:WIN), a leading technology innovation and licensing company, today announced that WiLAN has settled all patent litigation with UTStarcom Inc. (“UTStarcom”). The terms of the settlement are confidential.
On June 19, 2008, WiLAN initiated litigation in the U.S. District Court for the Eastern District of Texas (“EDTX”) against a number of major handset suppliers, alleging infringement of certain patents owned by WiLAN including U.S. Patent Nos. 5,282,222 (the “222 patent”) and RE37,802 (the “802 patent”). On July 7, 2008, UTStarcom completed the sale of its wholly-owned subsidiary, UTStarcom Personal Communications LLC, to Personal Communications Devices Holdings, LLC. The surviving entity, Personal Communications Devices, LLC (“PCD”), was added to this litigation on August 31, 2009.
To date, in this action, settlements have been reached with Research in Motion Limited and UTStarcom. LG Electronics Mobilecomm U.S.A. Inc., Motorola Inc. and PCD remain as defendants in this litigation.
“UTStarcom becomes the 11th handset maker and 99th company to reach an agreement with WiLAN, joining Research in Motion, Nokia, Samsung and many others,” said Bill Middleton, Senior Vice-President & General Counsel. “We are very pleased that we have been able to resolve our dispute through negotiation rather through continued litigation.”
