Mosaid Seeks Clarification of Disclaimer Term in Markman RulingOTTAWA, Ontario, Canada - April 06, 2004 – MOSAID Technologies Incorporated (TSX:MSD) today announced that it has filed a Motion for Limited Reargument or Clarification of Claim Construction (Markman) Ruling. The Motion seeks a clarification and amendment of the Markman Order delivered on March 22, 2004 by Judge William J. Martini of the United States District Court for the District of New Jersey in the ongoing patent infringement litigation between MOSAID Technologies, and Samsung Electronics and Infineon Technologies. The Markman Order construed the meaning of the patent claim terms in dispute between the parties. A copy of the Markman Order and Opinion, together with MOSAID’s Motion, is available at http://www.mosaid.com/licensing/samsung_litigation_update.htm MOSAID’s Motion requests an amendment to the definition of "double bootstrapping circuit" which was not one of the 30 disputed claim terms but was introduced by the Court as part of a disclaimer associated with a number of the terms. The Motion seeks a discretionary remedy granted in limited circumstances where evidence or issues have been overlooked. Ultimately the issue of whether the Samsung and Infineon DRAM products infringe MOSAID’s patents will be determined by the Court in the scheduled summary judgment motions or at trial. MOSAID filed a further motion yesterday for an order imposing sanctions against Samsung arising from its failure to deliver technical documentation related to its DRAM products.
